1. Introduction and Acceptance

Kohinoor Hosting ("we," "our," or "us") provides web hosting and related services to clients worldwide. By registering for or using our services, you ("client," "subscriber," or "you") agree to be bound by these Terms of Service (TOS), our Acceptable Use Policy (AUP), and our Privacy Policy. These documents collectively form the entire agreement between you and Kohinoor Hosting.

Our services are provided with reasonable care, but service interruptions may occur for reasons beyond our control. You agree that Kohinoor Hosting shall not be liable for damages caused by circumstances beyond our direct control.

2. Account Responsibility

Clients are responsible for all actions conducted through their accounts, including content hosted and emails sent. You agree to:

• Maintain the confidentiality of your login credentials (password, API keys).

• Use services lawfully and responsibly.

• Adhere to our Fair Usage Policies, including limitations on CPU, RAM, disk space, email sending, and bandwidth.

Fair Usage Policy for "Unlimited" Hosting Plans:

• CPU: 100% per account (as allocated by CloudLinux/LVE)

• RAM: 2GB per account

• Entry Processes: 25 per account

• Disk Space & Bandwidth: Soft limits apply (e.g., 100–200GB disk, 1TB/month bandwidth) to ensure fair distribution of resources.

• Emails: 300 emails/hour per cPanel account.

Accounts violating these limits may be suspended or terminated to protect server stability for all users.

3. Indemnification

You agree to defend, indemnify, and hold harmless Kohinoor Hosting, its employees, affiliates, and agents from any claims, damages, liabilities, costs, or expenses (including reasonable attorney fees) arising from:

• Your use of our services.

• Content you host, transmit, or distribute.

• Your violation of any applicable law, copyright, or third-party rights.

• Your breach of these Terms.

Kohinoor Hosting reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with us in asserting any available defenses.

4. Billing & Payments

• Services are billed monthly, quarterly, semi-annually, or annually depending on the plan selected at checkout.

• Refunds: Subject to a 7-day money-back guarantee from the initial sign-up date. This guarantee does not apply to domain registration/transfer fees, dedicated servers, VPS, or payments made via cryptocurrency or alternative payment methods.

• Accepted Payment Methods: Visa, Mastercard, American Express, Discover, PayPal, Alipay, WeChat Pay, Cryptocurrency.

• Auto-Renewal: All services auto-renew unless canceled prior to the next billing cycle. It is your responsibility to ensure your payment method is valid.

• Non-Payment: Failure to pay may result in suspension after 5 days and account termination after 30 days. Data may be permanently deleted upon termination.

5. Uptime & Service Guarantee

We strive for 99% uptime; however, we do not guarantee uninterrupted service. Certain events may impact service, including but not limited to:

• Scheduled maintenance (we will attempt to notify you in advance).

• Hardware failures.

• DDoS attacks exceeding our mitigation capacity.

Clients may request account credits for downtime via a support ticket. Kohinoor Hosting mitigates DDoS attacks up to available thresholds but cannot guarantee protection from all attack types.

6. Limitation of Liability

To the maximum extent permitted by law, Kohinoor Hosting shall not be liable for:

• Loss of data or content.

• Service interruptions beyond our control.

• Indirect, incidental, special, or consequential damages (including loss of profits or revenue).

Our total liability for negligence is limited to the fees paid by you for the service during the affected period.

7. Backups & Data Retention

Clients are solely responsible for maintaining complete and current backups of all website files, databases, emails, and other data stored on our services.

• We recommend using external storage solutions such as Wasabi, Amazon S3, or similar services.

• Kohinoor Hosting may provide automated backups for convenience only. Such backups are not guaranteed, may be unavailable, incomplete, corrupted, or deleted at any time, and should not be relied upon as your primary backup solution.

• Kohinoor Hosting shall not be liable for any loss of files, databases, emails, backups, or other data for any reason, including account suspension, termination, hardware failure, software failure, accidental deletion, malicious activity, or force majeure events.

8. Security

Kohinoor Hosting applies regular security patches to servers and services. Clients are responsible for the security of their websites, scripts, and passwords. Any compromise caused by client negligence (e.g., weak passwords, outdated software) is the client’s responsibility.

9. Suspension, Termination & Data Deletion

Kohinoor Hosting may suspend, restrict, terminate, delete, or refuse service to any account, at its sole discretion, with or without prior notice, for any reason including, but not limited to:

• Violation of these Terms or our policies.

• Abuse of system resources.

• Security risks.

• Non-payment.

• Spam or illegal activity.

• Operational, business, technical, or capacity management reasons.

Upon suspension or termination, services may immediately become inaccessible. Kohinoor Hosting may permanently delete account data, including website files, databases, emails, backups, and account information, without further notice.

Clients are solely responsible for maintaining their own backups before any suspension or termination.

10. Free Hosting Service

Free Hosting is provided as a complimentary service without any guarantee of continued availability, uptime, storage duration, or future access.

Kohinoor Hosting reserves the right to modify, limit, suspend, discontinue, or terminate Free Hosting services or individual Free Hosting accounts at any time, with or without notice.

Users acknowledge that Free Hosting accounts may be permanently removed due to capacity limitations, maintenance, inactivity, abuse prevention, security concerns, or business decisions.

Kohinoor Hosting has no obligation to restore terminated Free Hosting accounts or provide copies of website data after termination.

11. Paid Hosting

Basic Hosting and Unlimited Hosting are commercial services subject to these Terms and the applicable plan features. While Kohinoor Hosting makes reasonable efforts to maintain service availability, uninterrupted service is not guaranteed.

"Unlimited" resources are subject to Fair Usage limits (as defined in Section 2) and reasonable system resource consumption. Kohinoor Hosting may limit or suspend excessive usage that negatively impacts server performance.

Data Recovery for Former Free Accounts: Once a Free Hosting account has been terminated, data recovery is generally not available. If recovery is technically possible, it may be offered only after upgrading to a paid hosting plan. Recovery is not guaranteed.

12. Force Majeure

Kohinoor Hosting shall not be held responsible for any delay or failure in performance of its obligations to the extent that such delay or failure is caused by acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, shortages of transportation facilities, fuel, energy, labor or materials, or any other similar event beyond our reasonable control.

13. Governing Law & Dispute Resolution

These Terms of Service shall be governed by and construed in accordance with the laws of the United States of America, without regard to its conflict of law principles.

Dispute Resolution. Any dispute, claim, or controversy arising out of or relating to these Terms, the services provided by Kohinoor Hosting, or the relationship between you and Kohinoor Hosting shall first be attempted to be resolved through good-faith negotiations. If the dispute cannot be resolved informally, it shall be resolved exclusively through binding arbitration in accordance with the applicable rules of the American Arbitration Association (AAA) or another arbitration provider selected by Kohinoor Hosting.

The arbitration shall take place in the United States of America, unless otherwise agreed to in writing by Kohinoor Hosting. The arbitrator's decision shall be final and binding, and judgment upon the arbitration award may be entered in any court of competent jurisdiction.

Class Action Waiver. To the fullest extent permitted by applicable law, you agree that any dispute shall be resolved solely on an individual basis. You waive any right to participate in or bring any class action, collective action, consolidated action, or representative proceeding against Kohinoor Hosting.

International Customers. Kohinoor Hosting provides services to customers worldwide, including through operations in Nepal. By using our services, you agree that any dispute relating to these Terms or the services provided shall be governed by this Section to the fullest extent permitted by applicable law.

Severability. If any provision of this Section is found to be invalid or unenforceable under applicable law, the remaining provisions shall remain in full force and effect.

14. Disclaimer

Kohinoor Hosting cannot be held liable for:

• System downtime, crashes, or data loss.

• Predicted profits or income.

• Issues arising from third-party software, resold services, or content hosted by clients.
  Accounts may be suspended or removed without refund if TOS or policies are violated.

15. Changes to Terms

Kohinoor Hosting may revise these Terms at any time. Changes take effect upon posting on our website. Your continued use of the service after such posting constitutes acceptance of the updated terms.
